1. Introductory provisions
These auction rules govern the rules of online auctions organised by the operator on the website sedlacek-t.cz. By taking part in an auction, the participant agrees to these rules.
The auctions organised by the operator are auctions under Section 1771 et seq. of Act No. 89/2012 Coll., the Civil Code. This is not a public auction under Act No. 26/2000 Coll., on public auctions.
2. Definitions
- Auction – a time-limited sale of an item to the highest bid.
- Item – a specific machine or piece of equipment offered in the auction.
- Starting price – the lowest price from which bidding may start.
- Bid – an offer by a participant; minimum bid increment is the smallest possible increase.
- Buy now – an optional fixed price for immediate purchase, if stated for the item.
- Winning bidder – the participant with the highest valid bid at the moment the auction ends.
3. Registration and participation
Only registered and logged-in users may bid. By registering, the user confirms that the data provided is true, that they have legal capacity and are authorised to act (on behalf of the company in the case of companies), and agrees to these auction rules and to the processing of personal data. The operator may refuse or cancel a registration.
4. Course of the auction
Each item has a starting price, a minimum bid increment and a fixed end time. The current price and the countdown to the end are displayed online. A bid must exceed the current price by at least the minimum bid increment. Each bid is binding and cannot be withdrawn.
Extension of the end (against “sniping”): if a valid bid is placed in the last 2 minutes before the end, the end time is automatically extended by 2 minutes. This gives all participants the opportunity to react.
Buy now: if a “Buy now” price is stated for an item, the participant may buy it immediately at that price; this ends the auction of that item.
5. End of the auction and determination of the winning bidder
The auction ends when the (possibly extended) time expires or by using “Buy now”. The winning bidder is the participant with the highest valid bid. The winning bidder is notified by e-mail. Upon the fall of the hammer (the end of the auction), a purchase contract arises between the winning bidder and the seller.
6. Payment and handover
Payment takes place outside the website, by bank transfer to the account stated in the confirmation e-mail, within the due date stated therein. After the payment is credited, the operator arranges the handover and, where applicable, transport or installation. Ownership passes to the winning bidder upon full payment. Failure to pay on time is considered a withdrawal by the winning bidder.
Buy now: If a participant uses the „Buy now” button, the purchase contract is concluded immediately. The operator will issue the buyer an invoice payable within 48 hours of its issuance.
7. Condition of items and viewing
The machines offered are usually used and are sold “as they stand” (as is, where is). Photo documentation and a condition description are available for each item; a personal viewing before the auction is possible by arrangement. The participant acknowledges that they should examine the condition of the item before placing a bid.
8. Rights and obligations of the operator
The operator is entitled not to start, to suspend, extend or cancel an auction, in particular in the event of a technical error, an obvious inaccuracy of data or price, or for an important reason on the seller’s side. The operator is not liable for internet or device outages on the participant’s side.
9. Personal data protection
The participants’ personal data is processed by the operator (Sedlacek Trade s.r.o., Company ID 05164745) in accordance with the GDPR and applicable legislation, for the purpose of registration, participation in the auction and settlement of the transaction. 10. Final provisions
The operator may amend these rules; for a specific auction, the wording effective on the day it starts applies. Matters not governed by these rules are governed by Czech law, in particular the Civil Code. These rules take effect on 16 June 2026.
